Know Your Rights: Discovery Edition

The Landlord Has the Records.
You Have Not Because You Ask Not.
[James 4:2]

Once an eviction case is in court, California law gives you the right to request documents, answers, and admissions from the landlord — but you have to ask for them. This edition helps you understand that process, build your own requests, and know what to do when the landlord sends discovery to you.

Why It Matters

One of the Most Powerful Tools
and the Least Understood.

Discovery is the formal process for exchanging information before trial. Each side can ask the other for facts, documents, and admissions. For a self-represented tenant, it can be the difference between guessing at the landlord's case and actually seeing the records behind it — the notice calculations, the rent ledger, the registration status, the inspection history.

What's Inside

Build Your Discovery, by Issue.

The centerpiece of this edition is the Discovery Request Builder — a tool that helps you assemble your requests around the issues in your case instead of starting from a blank page.

Category-Based Builder

Start from the issues in your case — nonpayment of rent, habitability or retaliation, nuisance or lease violation, registration and compliance, disability and accommodation, post-foreclosure, or advanced defenses — and select from as many as apply.

RFA / SPROG / RPD Library

Browse Requests for Admission, Special Interrogatories (SPROGs), and Requests for Production, organized by case type and defense theme. Select the requests that match your facts.

Strategy Built In

Plain-language guidance on when a document "speaks for itself," how "YOU" and "YOUR AGENT" are defined, why to keep each request to a single actor, and how many tenants serve discovery in sets over time rather than all at once.

Compiled Discovery Set

When you're done selecting, generate a numbered, grouped list of your chosen requests — ready to copy into your own documents, fill in with your facts, and print.

The Flip Side

When the Landlord Sends Discovery to You.

Discovery goes both ways. This edition also helps you understand what to do when the landlord serves requests on you.

What You'll Walk Away With

More Clarity. Better Efficiency.
More Confidence.

Who It's For

Tenants Facing an Eviction in California.

The Know Your Rights: Discovery Edition is designed for tenants with an active unlawful detainer case in California who want to understand and use the discovery process. Unlike the Know Your Rights: City of Los Angeles Renter Edition, it has no geographic restriction — it applies to any active eviction case in the state.
Common Questions

Before You Purchase.

Do I need this if I already have another A Firm Foundation toolkit?
Each toolkit covers a different stage or dimension of an eviction case. The California Tenant Rapid Response System focuses on the notice stage. The California Tenant Rapid Defense System focuses on the summons, the complaint, and how to respond. The Know Your Rights: City of Los Angeles Renter Edition focuses on protections specific to the City of Los Angeles. And the Know Your Rights: Discovery Edition focuses specifically on discovery — the exchange of information once a case is in court.
Does this only apply in California?
This edition is built around California unlawful detainer cases, and the request library and deadline guidance are written for that fast-moving context. That said, the discovery process is the same across California civil actions — the concept and the request-building approach carry over to other case types. What changes is the law that applies: an unlawful detainer runs on a compressed timeline (responses due in days, not the longer periods in ordinary civil cases), so if you are using this outside an unlawful detainer, you would need to find the deadlines and rules that apply to your type of case. The city-specific protections belong to the Know Your Rights: City of Los Angeles Renter Edition.
Will this write my discovery for me?
It helps you assemble and organize requests from a library of examples, and it explains the strategy behind them — but the requests are samples meant to spark ideas, and you fill in the facts specific to your case. It is an educational tool, not a substitute for case-specific legal advice.
Is this legal advice?
No. This product provides general educational information and draft materials only. It is not legal advice and does not create an attorney–client relationship. Product output, including any AI-assisted content or templates, may be incomplete, inaccurate, or outdated. Users remain responsible for reviewing and verifying any output themselves and for deciding whether to seek case-specific advice from a licensed California attorney, a tenant-rights organization, or a legal aid organization before they rely on it, file anything in court, or make legal decisions.
